The Office of Foreign Labor Certification is aware that several SWA are experiencing technical problems which prevent them from placing and receiving job orders, including those required for foreign labor certification programs such as H-2A, H-2B, & PERM.

The Office of Foreign Labor Certification (OFLC) is aware that several State Workforce Agencies (SWA) are experiencing technical problems which prevent them from placing and receiving job orders, including those required for foreign labor certification programs such as H-2A, H-2B, and PERM.  We are monitoring this situation and will provide any updates as necessary.

For employers seeking to submit an H-2B application for temporary labor certification (TLC) and comply with the requirement at 20 CFR 655.16(a)(1) to submit a SWA job order concurrently with the filing of an H-2B TLC, please submit a copy of the job order to the appropriate SWA by email and as you would normally, upload a copy of the same job order in OFLC’s Foreign Labor Application Gateway.  SWA email addresses may be found here: https://www.dol.gov/agencies/eta/foreign-labor/contact
